These Terms & Conditions

govern your use of the Owl Web Website Builder service available at Owl Web.com.au.

By using our service, you agree to be bound by these terms.

Owl Web ("we", "us", "our")

1. Who Can Use This Service

You must be at least 16 years of age to use Owl Web. By using our service, you confirm that you have the legal capacity to enter into a binding agreement. If you are under 18, a parent or guardian must accept these terms on your behalf.

You may use the platform to build and manage websites for personal or business purposes, either for yourself or on behalf of your clients.

2. Your Account

Creating an Account

To use Owl Web, you'll need to register with a valid email address and password. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, please contact us immediately at support@Owl Web.com.au.

Account Accuracy

You agree to provide accurate information when signing up and to keep it up to date. We may suspend accounts that contain false or misleading information.

Inactive Accounts

We reserve the right to close free or inactive accounts (those unused for 12+ months) after giving reasonable notice.

3. Your Content

You Own Your Content

You retain full ownership of all content you create or upload to Owl Web — including images, text, videos, logos, and other files ("Your Content"). We do not claim ownership of your content.

Licence to Us

By using Owl Web, you grant us a limited licence to host, store, display, and process your content solely to provide and improve our services. This licence ends when you delete your content or close your account.

Content You Must Not Upload

You agree not to upload or publish content that:

• Is illegal, harmful, hateful, or defamatory

•  Exploits or endangers children

•  Infringes on someone else's intellectual property or privacy rights

•  Contains malware, viruses, or malicious code

•  Promotes scams, misinformation, or deceptive practices

•  Violates any applicable Australian or international laws

Your Responsibility for Content

You are solely responsible for ensuring your content is lawful, accurate, and backed up. We do not routinely monitor website content, but reserve the right to remove content that violates these terms.

4. Using the Platform Responsibly

You agree to use Owl Web lawfully and in accordance with these terms. In particular:

•       Only use content you have the rights to use

•       Comply with all applicable laws, including Australian consumer and privacy laws

•       Do not misuse the platform to harm others, send spam, or conduct fraudulent activity

•       Ensure any custom code you add to your site is secure and does not interfere with the platform

If you use Owl Web to create websites for your own clients, you are fully responsible for those client relationships, the content on those sites, and compliance with any legal obligations. Owl Web is a platform provider and is not responsible for your clients' websites or disputes.

5. Platform & Intellectual Property

Our Platform

All technology, design tools, templates, and software that power the Owl Web platform are owned by ProWebCraft LTD (Brizy) or its licensors. You are granted a limited,

non-transferable licence to use the platform while your subscription is active. You may not copy, reverse-engineer, or resell any part of the platform itself.

WordPress-Based Custom Sites

Some Owl Web services involve custom websites built on WordPress, an open-source content management system. Where a custom WordPress site is developed for you, the following applies:

•       WordPress core software is licensed under the GNU General Public License (GPL) v2 or later. Your use of WordPress is subject to the terms of that licence.

•       Third-party plugins and themes installed on your site may be subject to their own individual licences, including GPL, commercial, or freemium licences. Owl Web will endeavour to use reputable, well-maintained plugins and themes, but we make no warranties regarding their ongoing availability, compatibility, or support.

•       You are responsible for maintaining plugin, theme, and WordPress core updates after the completion of your project, unless you have engaged Owl Web under a separate ongoing maintenance agreement.

•  Owl Web is not responsible for issues, security vulnerabilities, or conflicts arising from third-party plugins or themes, including those introduced by plugin or theme updates after delivery of your site.

•  Where premium (paid) plugins or themes are used in the development of your site, licensing costs may be passed on to you or included in the project quote. You are responsible for renewing any such licences required for continued use of those tools. A list of third-party plugins and themes used in your WordPress project can be provided upon request. Templates & Demo Content

Templates and design assets provided on the platform are for use within your Owl Web websites only. Demo content (placeholder text and images) must be replaced before publishing a live site.

AI Features

Owl Web may include AI-powered tools that help generate website content or layouts. AI-generated content is a starting point — you are responsible for reviewing, editing, and ensuring all published content is accurate, appropriate, and legally compliant. AI content may not always be original or error-free.

Beta Features

We may offer experimental or early-access features from time to time. These are provided as-is without guarantees and may change or be removed at any time.

Your Feedback

If you share ideas or suggestions with us, you agree that we may use that feedback freely to improve our service, without any obligation to compensate you.

6. Fees & Subscriptions

Paid Plans

Certain features require a paid subscription. By subscribing, you agree to pay the fees shown at the time of purchase. All prices are in Australian Dollars (AUD) unless otherwise stated and may be subject to GST.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel beforehand. You can cancel at any time through your account settings.

Refunds

We offer a 30-day refund for new monthly or annual subscriptions purchased directly through Owl Web. Refunds are not available for renewals, lifetime plans, or add-ons. Contact support@Owl Web.com.au to request a refund.

Non-Payment

If a payment fails, we may suspend access to your paid features. We'll attempt to notify you and retry the payment before taking action.

Price Changes

We may update our pricing from time to time. Any changes will apply from your next renewal period, and we will notify you in advance.

7. Third-Party Services

Owl Web integrates with third-party tools such as payment processors, analytics platforms, and marketing tools. When you use these integrations, you are subject to their own terms and privacy policies. We are not responsible for the performance or practices of third-party services. For WordPress-based sites, third-party plugins and themes extend the functionality of your website and may connect to external services (for example, contact form processors, e-commerce gateways, SEO tools, or caching services). Each such plugin or theme operates under its own terms and privacy policy. Owl Web is not responsible for the practices, data handling, or ongoing support of third-party plugin or theme developers. If you embed third-party scripts or code on your website, you are responsible for ensuring those scripts comply

with applicable laws, including cookie and privacy regulations.

8. Service Availability & Changes

We aim to keep Owl Web running reliably, but we do not guarantee uninterrupted service. We may update, modify, or temporarily suspend parts of the platform for maintenance or improvements. Where possible, we'll give advance notice of significant changes. For WordPress sites, updates to WordPress core, plugins, or themes may occasionally affect your site's functionality or appearance. Where Owl Web manages maintenance on your behalf, we will take reasonable care when applying updates. If you manage your own WordPress site, you are responsible for testing and applying updates. We reserve the right to discontinue the service with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Owl Web is provided "as is" without warranties of any kind. We do not guarantee that the platform will be error-free, secure, ormeet your specific needs. Owl Web and its parent/underlying technology providers (including ProWebCraft LTD and third-party WordPress plugin or theme developers) will not be liable for any indirect, incidental, or consequential loss arising from your use of the platform — including loss of data, revenue, or business opportunity. Our total liability to you for any claim arising from your use of Owl Web will not exceed the amount you paid to us in the 12 months before the claim arose.

10. Your Privacy

We take your privacy seriously.

How we collect, use, and protect your personal information is explained in our Privacy Policy at OwlWeb.com.au/privacy. By using Owl Web, you agree to our Privacy Policy. If your website collects personal data from visitors, you are responsible for having appropriate privacy notices, cookie consent, and data handling practices in place under the Australian Privacy Act and any other applicable laws. For WordPress sites using plugins that collect or process personal data, you are responsible for

reviewing and complying with those plugins' data handling practices.

11. Marketing Communications

From time to time, we may send you emails about our services, new features, and promotions. You can unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting support@Owl Web.com.au. We will always send you important transactional emails about your account (such as billing receipts and

security notices), regardless of your marketing preferences.

12. Termination

You may stop using Owl Web at any time by cancelling your account. We may suspend or terminate your account if you breach these terms, misuse the platform, or fail to pay your subscription fees. Upon termination, your websites and content may be deleted. It is your responsibility to download or back up your content before closing your account. For WordPress-based sites, you are responsible for ensuring you retain access to your hosting environment and any site backups at the conclusion of our engagement.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the updated version at Owl Web.com.au/terms and update the "Last updated" date at the top. Your continued use of Owl Web after any changes means you accept the updated terms. For significant changes, we'll do our best to notify you by email.

14. Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of the Australian courts.

Nothing in these terms limits your rights under the Australian Consumer Law, including consumer guarantees that cannot be excluded by contract.
